User Agreement
1. Terms and Definitions Used in the Agreement.
In the Agreement, unless the text directly implies otherwise, the following words and expressions shall have the meanings indicated below:
1.1. The Site – a set of software and hardware tools for computers that ensure the publication of information and data for public viewing, united by a common purpose, through technical means used for communication between computers on the Internet. The Site is located on the Internet at: https://zarubejom.ru/.
1.2. Administrator/Owner of the Site – Joint Stock Company “Eurasian Media Group” (PSRN: 1027700016630, TIN 725154610), located at: Russian Federation, 127287, Moscow, 2nd Khutorskaya Street, 29, building 4.
1.3. Content of the Site includes all objects posted on the Site, including design elements, text, graphic images, illustrations, videos, scripts, programs, music, sounds, and other objects, as well as their selections. The Site Owner is the holder of exclusive rights to use the Site, including all its Content.
1.4. User – an Internet user, in particular, a user of the Site.
2. General Provisions.
This Agreement establishes the terms of use of the zarubejom.ru website (hereinafter referred to as the “Site”) by the User, which is an information resource provided by JSC “Eurasian Media Group”.
This Agreement is concluded between the Site Owner and any person who becomes a User of the Site after accepting the terms of this Agreement.
In accordance with Article 435 of the Civil Code of the Russian Federation, this User Agreement is recognized as a public offer.
In accordance with Article 438 of the Civil Code of the Russian Federation, the unconditional acceptance (acceptance) of the terms of this Agreement is considered to be the fact of the User beginning to use the services of the Site provided by the Site Administrator.
This Agreement, concluded by accepting this offer, does not require bilateral signing and is valid in electronic form.
By accessing the Site, the User accepts the terms of this Agreement in full.
The Site Owner reserves the right to change the terms of this Agreement and all its integral parts without the User’s consent by notifying the User through the posting of a new version of the Agreement or any of its integral parts on the Site. Taking into account that information mailings may be recognized as spam by the Parties, the User undertakes to review the content of the Agreement posted on the Site at least once a month in order to be timely informed of any changes. The new version of the Agreement and/or any of its integral parts comes into force from the moment of its publication on the Site, unless a different effective date is specified by the Site Owner upon publication.
The current version of the Agreement and all its appendices is always available on the Site in the public domain at: https://zarubejom.ru/terms/.
JSC “Eurasian Media Group” reserves the right at any time to terminate or change the procedure for providing services (on a permanent or temporary basis) to the User or all users, solely at its own discretion and without prior notice. The User has the right to stop using the Services at any time without notifying JSC “Eurasian Media Group”.
3. Rules for Using the Site.
The User is personally responsible for any information they post on the Site, send to other Users, as well as for any interactions with other Users.
The Site contains materials protected by copyright, including but not limited to trademarks, texts, photographs, video materials, graphic images, musical and sound works.
All content of the Site is protected by copyright as a work created by collective creative labor in accordance with the legislation of the Russian Federation on copyright and related rights. JSC “Eurasian Media Group” owns the copyright both to the selection, arrangement, systematization, and transformation of the data contained on the Site, and to the original data itself, except in cases specifically established by this Agreement or separately noted in the content of materials published on the Site. The User has no right to modify, publish, transmit to third parties, participate in the sale or assignment, create derivative works, or otherwise use, in whole or in part, the content of the Site. The information provided on this Site is presented as public information (unless otherwise indicated in the materials) and may be freely distributed or copied only for non-commercial use for informational, scientific, educational, or cultural purposes. The use of any material posted on this Site, or its citation in the media, is permitted only with reference to the source indicating the internet page from which the materials were taken.
Unless otherwise provided by copyright and related rights legislation, copying, distribution, transfer to third parties, publication, or any other commercial use of the Site’s materials is not permitted without obtaining written permission from JSC “Eurasian Media Group” or another legal copyright holder.
The User undertakes not to upload, post, or otherwise use on the Site any materials that are subject to copyright or other rights of third parties (including the right to privacy or the right to an image of a citizen) without the consent or permission of the copyright holder, or any other legally justified right to upload, post, and make such material publicly available. The User bears sole responsibility for any damage arising from the infringement of copyright or other rights to protected materials, as well as for any damage arising from uploading such materials to the Site.
By uploading any materials to the Site’s sections for public use, the User thereby automatically grants JSC “Eurasian Media Group” or confirms that the owner of such materials has granted JSC “Eurasian Media Group” a free, perpetual, irrevocable, non-exclusive right to use, reproduce, modify, edit, publish, translate, make publicly available, and distribute such materials (in whole or in part) worldwide and/or to include such materials in other works in any form through any media or technologies now known or that may be invented in the future, for the maximum possible term of copyright protection permitted by law. The User also permits other Users to access, view, store, or reproduce such materials for personal use.
The Site Owner has the right to:
Dispose of statistical information related to the functioning of the Site, as well as User information, to ensure targeted display of advertising information to various audiences of the Site’s Users.
Send the User information about the development of the Site and its services; send SMS messages for the purpose of informing about activation codes, conducting surveys on the quality of the Site’s operation, providing and requesting other information, as well as advertising its own activities and services.
4. Limitation of Liability.
The User hereby assumes all risks associated with the use of the Site. Neither JSC “Eurasian Media Group”, nor its employees, agents, suppliers, or content producers and licensors guarantee the absence of errors or uninterrupted operation of the Site. At the same time, the above-mentioned parties do not provide any warranties regarding the possible results of using the Site or regarding the accuracy, reliability, or content of any information, service, product, or Services implemented through the Site.
The Site’s services are provided on an “as is” basis, without any warranties, express or implied, including the warranty of fitness for any particular purpose. This does not exclude warranties that follow from the law or cannot be excluded, limited, or modified by the legislation applicable to this Agreement.
Under no circumstances shall JSC “Eurasian Media Group” or the persons involved in the creation, production, or distribution of the Site’s products or software be liable for any losses, including but not limited to direct and indirect losses or losses caused by the consequences of using the Site, as well as losses from the payment of fines arising in connection with the use or inability to use the Site. The User hereby acknowledges that the provisions of this section apply to all content of the Site.
The User undertakes to:
Comply with all terms of this Agreement.
Not to transfer information about other Users obtained through the Site to third parties.
Not to post personal data of other persons on the Site, nor to use the personal data of other Users in any way that does not comply with the requirements of the legislation of the Russian Federation, for unlawful or illegal purposes, for the purpose of obtaining benefits, or for any other purposes that do not correspond to the purposes of creating the Site.
Not to use software or perform actions aimed at disrupting the normal functioning of the Site and its services; not to use automated scripts (programs) to collect information on the Site and/or interact with the Site and its services without special permission from the Site Owner.
5. Confidentiality and Protection of Personal Data.
Within the framework of this Agreement, “User’s personal information” means:
personal information that the User provides about themselves independently during registration (creating an account) or in the process of using the Site, as well as other information provided by the User at their own discretion;
data that is automatically transmitted during use through the software installed on the User’s device, including IP address, cookie information, information about the User’s browser (or other program used to access the Site), access time, and the address of the requested page;
JSC “Eurasian Media Group” has the right to request the User’s personal data through the Site, and the User has the right to provide such data.
The User’s voluntary registration on the Site for the purpose of participating in JSC “Eurasian Media Group” projects and gaining access to the Site’s services means full consent, in accordance with Article 9 of Federal Law No. 152-FZ of July 27, 2006 “On Personal Data”, to the automated and non-automated processing and use of their personal data provided to JSC “Eurasian Media Group”, and also guarantees the accuracy of the data provided. The processing and storage of the User’s personal data is carried out in accordance with the current legislation of the Russian Federation.
JSC “Eurasian Media Group” collects and stores only those personal data that are necessary for the provision of services and may be used for the following purposes:
identification of the User on the Site and provision of personalized services of the Site;
communication with the User, including sending notifications, requests, and information related to the use of information products, materials, and/or data of the Site;
provision of services, as well as processing of requests and applications from the User;
targeting of advertising materials;
conducting statistical and other research;
general information on movements around the Site for content optimization.
The following actions may be performed with the User’s personal data by the Site Owner: collection, recording, retrieval, systematization, accumulation, storage, use, transfer (distribution, provision, access). Personal data may be used in a mixed manner, using the Internet information and telecommunications network and cross-border transfer.
JSC “Eurasian Media Group” maintains the confidentiality of the User’s personal information, except in cases where the User voluntarily provides information about themselves for public access to an unlimited number of persons when using certain services, including third-party ones (for example, Twitter, VKontakte, etc.). The User agrees that a certain part of their personal information becomes publicly available.
The User is aware that if they log in to the Site through social network accounts, the rules and conditions of the respective social networks apply to them, including with regard to the processing and use of personal data and ensuring their confidentiality.
JSC “Eurasian Media Group” has the right to transfer the User’s personal information to third parties in the following cases:
The User has expressed consent to such action;
The transfer is necessary within the framework of the User’s use of a particular service or for providing a service to the User;
For the purpose of fulfilling the requirements of the law or court decisions, to protect the rights and legitimate interests of JSC “Eurasian Media Group”, and to protect the personal safety of the Site’s Users.
The User may at any time change the personal information provided by them, as well as delete it within a specific account.
JSC “Eurasian Media Group” takes the necessary organizational and technical measures to protect the User’s personal information from unauthorized access, destruction, modification, blocking, copying, or distribution.
The terms of Section 4 apply only to the zarubejom.ru website. JSC “Eurasian Media Group” does not control and is not responsible for third-party websites that the User may access via links available on the Site. The User must independently familiarize themselves with the personal data protection conditions on such websites.
6. Consent to the Terms of the Agreement.
This Agreement enters into force at the moment of accessing the Site. If you do not accept the terms of this Agreement in their entirety, please leave the Site immediately.
